The Carbon Nanotube Patent Landscape

Abstract: Carbon nanotubes could be used in products across
several different industries ranging from electronics to materials to
health care. Because of their enormous commercial potential,
universities, start-ups, and corporations have aggressively sought
patent protection on nanotube-based products. In this presentation,
IP attorney Drew Harris lays out carbon nanotube patent landscape,
identifying key building block patents and summarizing potential
arguments as to why some of these patents may be invalid. He will
review some prior art from the 1970s and 1980s that could potentially
be used to invalidate certain nanotube patents, and will discuss
nanotechnology patent infringement actions currently being litigated.

Dr. Drew Harris
is an attorney with Graves, Dougherty, Hearon &
Moody in Austin, TX and is a Co-founder and Managing Editor of
Nanotechnology Law & Business, a peer reviewed quarterly journal.
Harris attended the University of Texas at Austin and Stanford Law
School, and clerked for the Honorable John G. Koeltl, U.S. District
Judge for the Southern District of New York. Harris specializes in
Internet-related and intellectual property litigation, with a particular
emphasis on nanotechnology patent law. He has published and
spoken extensively on nanotechnology, and served as Chair of the
Nanotechnology Subcommittee for the Science & Law Committee of
the New York City Bar Association. Harris is licensed to practice in
New York, but not yet licensed to practice in Texas.
